Spot of Honey (D.B.A. “Techie to the Rescue”) provides the following education or support described here to you or “member” of any “Techie to the Rescue” packages or services with the following Terms and Conditions. When you make any monetary transaction with Techie to the Rescue you are agreeing to these Terms and Conditions. DO NOT ENGAGE IN ANY PROGRAMS, SERVICES, OR SESSIONS WITHOUT FIRST READING AND UNDERSTANDING ALL OF THE TERMS LISTED. THESE TERMS AND CONDITIONS ARE AVAILABLE UPON REQUEST AND WILL BE PROVIDED BEFORE ANY BASIC MEMBERSHIP, PACKAGE MEMBERSHIP, OR SERVICE IS PURCHASED.
Minors: If service is purchased by a minor (under 18) or on a minor’s behalf, an adult over the age of 18 must be present for the duration of the appointment.
Service Terms: Services consist of online events, over the phone support, in person support, and other services. Sessions and services are available on a first-come first-served basis and are subject to availability.
Techie to the Rescue is an independent service and has not been authorized, sponsored, endorsed or otherwise approved by Apple Inc. Apple® is the sole owner of its trademark and does not endorse this business, service or its offerings. AppleCare® and AppleCare+® are registered trademarks of Apple Inc.
TYPES OF MEMBERSHIPS
No Membership: If you opt to not engage in a membership or package you agree to pay $120 per hour serviced. You will be provided the option before the session begins to pay a member fee of $50 which will then reduce future sessions to $99 per hour. These prices are subject to change and more details can be found under the Basic Membership category. Calls over the phone take place in 60 minute increments. The calls are meant to be ended at the 50 minute mark which allows 10 minutes for review, determining next steps, and scheduling the next call.
Basic Membership: Basic Membership is available for purchase to those customers or businesses that would like multiple Tech Rescue Service calls at a discounted rate. Basic Membership expires at the end of the one year period from date of activation. Members may renew their Basic Membership within thirty days of expiration. Members may be denied renewal if it is found that they have not followed these Terms and conditions as listed, if there are not an adequate amount of spots, or if the program is no longer available for the next year. Techie to the Rescue Basic Membership services are not transferable. Techie to the Rescue reserves the right to refuse, limit, or cancel any service and/or Basic Membership for any reasonable cause, including without limitation if, in the opinion of Spot of Honey, doing business as “Techie to the Rescue,” a basic member is using services in conjunction with offensive, illegal, or otherwise inappropriate content or material; displays unreasonable, abusive, or disruptive behavior; requires unusual or extensive services/training beyond the scope of these Terms and Conditions or Techie to the Rescue’s typical service offerings; or has otherwise breached these Terms and Conditions.
Jumpstart on a Budget Package: Jumpstart on a budget provides (1) 7 units to be used on future projects (not redeemable as cash); (2) AppleCare and AppleCare+ rebate of up to $100 on a qualifying purchase as outlined in this document; (3) Weekly Tech News Audio Show (recording only); (4) Weekly Live Q+A; (5) Three online training workshops (recordings only); (6) Access to all videos and ebooks in SuperTechie Hero University; (7) Additional unit purchase at $95 per unit hour. Please see paragraphs concerning each of these sections for additional information. Package lasts for 3 months before renewal with ability to lower the price by paying in one lump sum.
Jumpstart Package: Jumpstart provides (1) 55 units to be used on future projects (not redeemable as cash); (2) AppleCare and AppleCare+ rebate of up to $500 on a qualifying purchase as outlined in this document; (3) Weekly Tech News Audio Show (recordings only); (4) Weekly Live Q+A; (5); (5) Access to all videos and ebooks in SuperTechie Hero University; (6) Additional unit purchase at $90 per unit hour; (7) Six online training workshops (recordings only); (8) Basic Welcome Kit. Premium Package: Premium provides (1) 60 units to be used on future projects (not redeemable as cash); (2) AppleCare and AppleCare+ rebate of up to $1000 on a qualifying purchase as outlined in this document; (3) Weekly Tech News Audio Show (live when available and recordings); (4) Weekly Live Q+A; (5) Access to all videos and ebooks in SuperTechie Hero University; (6) Additional unit purchase at $85 per unit hour; (7) Twelve online training workshops (live and recordings); (8) Private Facebook Group; (9) Deluxe Welcome Kit. Terms and Conditions Related Specifically to Personal Super Techie Hero Packages
In Person Sessions: Sessions in person will only take place in the New England area. For any location outside of a 60 mile radius of Sharon, Ma, additional charges will apply.
Over the Phone Coaching: Sessions may be conducted over the phone or utilizing an over the internet system. These communicating systems could include FaceTime, Skype, LogMe In, or any other software available for communication. If you feel a screen share is necessary you are responsible for setting up the sharing system or using a session to go over how to download the system. During the session be prepared to use email, messaging services, and other means to send or receive documents.
AppleCare and AppleCare+ Rebate: As stated above Apple does not endorse this program. As long as you are an active package member you will receive a rebate up to the amount specified in your package. Not all packages provide said rebate.
Repair Terms and Conditions: You authorize Techie to the Rescue to facilitate the transfer of your product from your home or place of business to an Apple® approved repair facility. If there is not a Genius Bar® in your area an adequate replacement may be determined in its place. You agree to all current terms and conditions concerning repair at that facility. You authorize Techie to the Rescue to act on your behalf and execute a repair. If there is a cost for repair you will be provided with an estimate of the cost. If you decide not to engage in the repair or do not answer communication concerning the repair we will consider this as you not wanting the repair. Before providing the repair we will request to know the most you are willing to pay for said repair. If it is over budget we will consider that a rejection of repair unless you would like to pursue said repair. You are responsible for all labor and parts that are charged to you. You acknowledge that your device may be sent out by common carrier to be serviced by an external service provider. For this reason, it’s recommended that you back up your device and wipe it, prior to submission for service. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN TECHIE TO THE RESCUE’S CUSTODY, SPOT OF HONEY’S LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PRODUCT. Apple and the Genius Bar has the right to deny service due to the end user not being present. In the event this happens we will work with you to find other alternatives for repair.
Remote Personal Shopper: You authorize Techie to the Rescue to facilitate the recommendation of new technology for your needs. You will be asked to provide information on what technology you are currently using, what you plan on doing with technology in the future, and what you wish you could be doing with your current technology. We will provide you with recommendations and reasons why you might want to purchase any of a selection of recommended products, based on the information you provide. It will be up to you to make the determination to accept or reject the recommendations. Links provided may contain affiliate links which benefit Techie to the Rescue. You are not obligated to utilize the direct links sent to you. We will only make recommendations that are good for you and your budget, and that will support your future technology needs. We cannot predict the future and may make a suggestion that may become outdated twenty four hours after being sent due to the ever changing pace of the technology industry.
In Person Tech Support Session: Sessions are booked in three hour blocks to allow Techie to the Rescue to best support your technology needs. Some technology takes longer than three hours to fix or may be unfixable by Techie to the Rescue, requiring additional outside support. You agree to have all equipment, passwords, and information available in order to facilitate this process. You acknowledge that the owner of the technology, or someone familiar with what needs to be accomplished in the session, must be available and able to explain what needs to be done, and able to learn or adequately record the results. You are willing to utilize outside technical support from services and platforms and will authorize Techie to the Rescue to speak on your behalf to solve the tech issue. Support Sessions are not there for Techie to the Rescue to do all of the work without your participation, and you are encouraged to take notes and ask questions so you understand the process of troubleshooting your device. If you have wifi available in your home or place of business you may be asked for the password for your router to allow us to service you better, and you agree to provide said passwords. If a fourth hour is needed it is up to you to decide if you would like to continue. Under certain unusual circumstances the full hour may not be necessary and Techie to the Rescue may determine that not all of the units need be used.
Techie on the Road: Techie on the Road is divided into two categories: speaking at your event, and/or helping to set up your presentation equipment. Should you choose to hire Techie to the Rescue as a speaker the client will provide a suitable venue with appropriate heating, lighting, and ventilation. Techie to the Rescue will require confirmation that all necessary regulations are met by the client for fire, safety and any other statutory regulations of the venue, and that the client has ensured that the maximum audience capacity for the venue is not exceeded. Suitable insurances include adequate public liability insurance and agreement that the client shall indemnify the Speaker against any action, claim, demand or proceeding made against the Speaker by any person, firm, company, government authority or agency, arising out of or in connection with the organization or conduct of the activities and opportunities by the Client or by any person at the Client’s direction or with the Client’s authority or permission, together with all costs and expenses which may be incurred by Spot of Honey or Techie to the Rescue in connection herewith. All technical requirements, room layout and stage accessories requested prior to the engagement that are necessary for the Speaker to perform the services must be supplied in good working order, and in particular, suitable amplification must be ensured. Any speaker support material requested by the Speaker in connection with this engagement and to be produced by a company approved by the Speaker must also be provided, along with a drawn out plan of exactly what is needed for the event to create a seamless experience. The Client undertakes not to permit any person to make any sound recording or video recording of the Speaker’s participation in or performance of the Services unless authorized by Spot of Honey in writing. Copyright and other intellectual property rights on any of the materials used for or in connection with the event shall be and remain vested in Spot of Honey.
In Person Personal Shopping: You will be met at a predetermined location and escorted to the desired store for the duration of the session. It will be up to you if you want to discuss and browse the store together before speaking with an associate. You are under no obligations to make any purchases during the session. You will have the ability to end the session at any time or ask for us to go outside of the store and discuss any questions or clarify any information that may not make sense to you. Techie to the Rescue is not responsible for the experience that the store provides and may even support or question the associate on your behalf. Before we begin please communicate with us about how much of an active role you would like Techie to the Rescue to take on during the appointment and what your experiences in technology stores have been in the past.
Learning Sessions Services are intended for informational and entertainment purposes only. You can participate in any of these sessions by using your own product or, subject to availability, a product may be provided to you by Techie to the Rescue, but this is not guaranteed.
Online Sessions’ Schedules and Topics are determined by Techie to the Rescue and are subject to change by Spot of Honey’s reasonable discretion. Reservations for Sessions are subject to availability on a first-come, first-served basis; therefore, Techie to the Rescue makes no guarantee as to the minimum number of sessions you may be able to attend during the term of your package membership or that you will use all of your units. You acknowledge that you are responsible for keeping track of any unused units and using them before the end of your package period. Package members must book their reservations online using the provided service website. The company administrating the units is subject to change at any time and you acknowledge that this is ok without any prior permission granted. There may be blocks of time during which services will be unavailable which may include American and Jewish holidays. During these times there will be an expectation of no electronic communication with Techie to the Rescue until the end of the holiday or the period of time from Friday afternoon (12pm EST) to Monday morning (11 am) weekly. Techie to the Rescue will provide a list of all of these blackout days in advance with your package membership kit. In person sessions are offered in 3 hour increments and include up to 5 or 10 minutes to gather belongings and draw the session to a close. Over the phone sessions are in 60 minute increments, ending at 50 minutes and allowing for 10 extra minutes for further questions or discussion if deemed necessary. Calls must end by the end of the 60 minutes unless it is pre-determined that more time is necessary. Training Session increments are approximations and the actual duration of any session may need to be shortened from time to time in order to reasonably maintain timely scheduling. Further, Spot of Honey reserves the right in its reasonable discretion to change, postpone or cancel the date and time of any Training Session (e.g., during periods of increased traffic and need).
Online Training Workshops: A total of 12 will take place during the year with access granted based on which package you choose. Topics will range based upon the interest of those attending. We cannot guarantee that all subjects will be discussed. The terms of your package will determine if you are attending live or watching a replay video of the Online Training Workshops. Techie to the Rescue may allow free or reduced rate live passes to be given away to non-members as a trial period promotion to allow for those who wish to experience a workshop to be able to do so. You hereby give permission for Techie to the Rescue to use your voice, image, or any other contribution to these sessions for future promotion and/or for use of creating packages without compensation being rendered forthwith. Information provided in Online Training Workshops is for entertainment and informational purposes only and any action you take based upon it is considered your own responsibility.
Units: Units can be purchased individually. To purchase a unit at a reduced price, one may utilize a membership or package to reduce the cost. Units can be used to book sessions and other services. Units expire at the end of the package. If additional units are purchased above and beyond what is provided in the package you will have 90 days to utilize said units before they expire if you do not renew the package or membership. Amount of units per session is subject to change and you will receive thirty days’ notice of these changes as a package member in current standing. There may be certain times of year when unit discounts may take place and it is up to you to trade in those units during those times.
Weekly Tech News Audio Show: A great way to keep up with the latest news happening in the Technology World. Techie to the Rescue may have to change schedule due to unforeseen circumstances or when a hiatus is necessary. There will be no make up time for these missing shows. A good faith effort will be made to consistently provide the latest news that will keep you informed on where the technology marketplace is going. Premium members may have the ability to listen in live. Live recordings may include unfiltered mistakes and errors before the shows are polished into their final edits.
Weekly Live Q + A: Techie to the Rescue will provide the audience with the opportunity to ask questions that are on their minds, and the audience may learn together with Techie to the Rescue. Some questions may need to be answered in a future Q+A session. There is no guarantee that everything will be answered. The Q+A sessions should only be considered entertainment and for informational purpose only.
Super Techie Hero University: A collection of resources combining media, photos, documents and more. Additional resources will be provided on an ongoing basis. There is no guarantee as to the amount of material that will be made available. You will only be able to access the material while a package member in good standing.
Welcome Kit: The basic welcome kit consists of one notebook, one pen, one usb-stick, and one tote bag. Products in welcome kit may be subject to change and may be replaced with products of similar value. Premium members will receive a deluxe welcome kit containing everything in the basic kit and additionally, an external hard drive for the purpose of backing up a computer system. The products represented do not endorse Techie to the Rescue nor support its cause or mission. Any warranty must be handled with the third parties that provide manufacturer’s warranties. The Welcome Kit is a free gift for when you first sign up for the Techie to the Rescue Jumpstart and Premium Packages, and may take several days to arrive to you based on your location and shipping factors. We do not guarantee that with renewal you will receive a Welcome Kit as this shall be considered a free bonus for signing up for the first time. Only one welcome kit per family.
Private Facebook Group: You must have a valid Facebook account to participate. The Private Facebook Group allows you to network with other members of the Premium group while also asking each other and Techie to the Rescue for help or support for your Techie needs. If it is found that more rules need to be provided this section will be updated. Package Members can be removed for not cultivating a positive environment and becoming a distraction to the group. Three warnings will be provided before you will be removed from the group. You may not use the group to spread hateful propaganda, and this will be strictly enforced. You may provide discounts to other members for your products within reason as long as they don’t compete with Techie to the Rescue’s business, or provided that adequate compensation is offered to Techie to the Rescue for said solicitation.
Your Information: You agree and understand that it is necessary for Spot of Honey, doing business as “Techie to the Rescue,” to collect, process, and use your personal information in order to perform the service and support obligations under your Basic Membership. Basic Members and Package Members may also receive periodic membership-related communications from Techie to the Rescue, such as notices regarding expiration of your account and changes to the program. You may also receive requests to provide feedback or answer a few questions to improve the service. No compensation will be provided for these additional research mechanisms and participation in sessions is optional and shall not be deemed as mandatory.
Preventing Data Loss: You understand and agree that Techie to the Rescue shall not be liable for any loss, damage, corruption, disclosure or alteration of any files, folders, data, programs or any of your confidential, proprietary, business and/or personal information or removable media (“Data”). You are responsible for any and all restoration and reconstruction of lost, damaged, corrupted, or altered Data. You ensure that any information or Data disclosed to Techie to the Rescue is not confidential or proprietary. YOU ARE ENCOURAGED AND EXPECTED TO TAKE ADEQUATE MEASURES TO AVERT AND REDUCE POTENTIAL DATA LOSS AND DAMAGES. YOU ACKNOWLEDGE THAT YOU MAY AND CAN LOSE YOUR DATA DURING A SESSION OR PARTICIPATING IN ANY PART OF TECHIE TO THE RESCUE. IN PARTICULAR, BEFORE YOU BEGIN, IT IS YOUR RESPONSIBILITY TO BACK UP ALL EXISTING DATA ON YOUR COMPUTER DISKS AND/OR DRIVES, AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION, AND DISCONNECT MEDIA OR DEVICES SUCH AS CDS, DVDS, PC CARDS, OR FLASH DRIVES. YOU ACKNOWLEDGE THAT WE WILL NOT BE HELD LIABLE FOR ANY ILLEGAL ACTIVITY THAT YOU ARE PERFORMING ON YOUR DEVICE INCLUDING PIRACY OR OTHER ILLICIT ACTIVITIES. IF ANY SUCH ACTIVITIES ARE TO BE DISCOVERED TECHIE TO THE RESCUE HAS THE RIGHT TO END THE AGREEMENT WITHOUT PROVIDING ANY REFUND FOR BREACH OF CONTRACT.
Installing Software: You represent that you have the legal right to access, copy, or use any such data and to permit Techie to the Rescue to do so, and authorize any such use by Spot of Honey. You also agree that if any service involves installing software on your Product, you have the legal right to agree to the terms of any applicable software license and authorize Spot of Honey to accept such terms on your behalf in performing the services.
Warranty: To the maximum extent permitted by law, all Techie to the Rescue services, including any documentation, publications, or other information provided therein by or on behalf of Spot of Honey to member, are furnished on an “AS-IS” basis without warranty of any kind as to their accuracy or completeness.
THE WARRANTIES, CONDITIONS, AND REMEDIES CONTAINED IN THESE TERMS AND CONDITIONS ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, AND REPRESENTATIONS. EXCEPT AS PROVIDED HEREIN, AS PERMITTED BY APPLICABLE LAW, SPOT OF HONEY SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS, AND REPRESENTATIONS RELATED TO OR ARISING IN ANY WAY OUT OF THESE TERMS AND CONDITIONS, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, SATISFACTORY QUALITY, CARE, SKILL, OR FITNESS FOR A PARTICULAR PURPOSE. NO SPOT OF HONEY EMPLOYEE OR AGENT IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS WARRANTY.
Limitation of Liability: SPOT OF HONEY AND ITS AFFILIATES, EMPLOYEES, AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PROGRAM OR SERVICES, INCLUDING BUT NOT LIMITED TO COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA, OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, OR ANY LOSS OF BUSINESS, PROFITS, REVENUE, OR ANTICIPATED SAVINGS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPOT OF HONEY AND ITS AFFILIATES’, EMPLOYEES’, AND AGENTS’ TOTAL AGGREGATE LIABILITY TO CUSTOMER FOR ANY AND ALL CLAIMS ARISING UNDER THE PROGRAM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR MEMBERSHIP.
For Training Access
You will receive access to the training platform for the amount of time that was stated on the product description you purchased. Purchase of a training module does not grant rights to the buyer to share, reproduce, or resell the product in any way.
There are no refunds regardless of usage of the product. All digital and downloadable product sales are final. We do not offer digital product refunds; once a download/digital access has been assigned to you there is nothing we can retrieve back. If you are attempting to cancel your automatic renewal please contact us 30 days before the renewal.
Please be advised that any and all Agreements for downloadable/digital products, and On Demand digital products, are NOT subject to cancelation, refund, or store credit. We do not accept any verbal modifications of these Agreements and the “no refund and no cancelation” policy stated in the Agreements is strictly adhered to. AFTER the full term of the Agreement has expired, you may request to cancel the automatic renewal of the Agreement or your Agreement will be converted into a year-to-year Agreement. Any cancelations submitted prior to the full term of the Agreement will only cancel the auto renewal and your monthly invoices will still be due and owing until the full value of the Agreement has been paid in full.
Canceling or removing the credit card on file does not cancel your subscription and violates the terms of the Agreement. If at any time you have delinquent invoices past 90 days, or the account is paid delinquently for three consecutive payments, your account will be suspended, and you will still be liable for the full contract value through the term of the Agreement.
If a product or service is purchased utilizing a monthly payment plan you are responsible for 100% of agreed-upon payments equaling the original purchase price of the product. If any payments are not received, the entire purchase is void and the payments made up to that point are forfeited to and will not be refunded. Access to any digital product or platform will be removed. Any payment plans that include live events must be paid in full 30 days prior to the event date or your ticket will be forfeited, and you will receive a credit in the amount paid up to 30 days after the date of the event.
Returning Items from Deals that Included Gifts with Purchase and Bonus Items:
If you are returning an item or requesting a store credit on any item purchased with a bonus or free gift, you are required to return the bonus or free gift. If you chose to retain the bonus or free gift, your refund or store credit will be reduced for the value of the bonus and free gift at the time of your purchase.
Updates to Terms and Conditions: Be sure to return to this Policy periodically to review the most current version of the Policy. We reserve the right at any time, at our sole discretion, to change or otherwise modify this Policy without prior notice; however, the date of any effective changes shall be reflected at the bottom of this page and upon request we will provide you with information regarding any changes made.
Force Majeure: In the event that this Agreement cannot be performed or any of its obligations fulfilled for any reason beyond the reasonable control of either party including war, industrial action, floods, etc. then such non-performance or failure to fulfill the obligation hereunder shall be deemed not to be a breach of the terms hereof.
In the event that the circumstances described continue for more than one calendar month either party may terminate this Agreement forthwith on serving written notice to the other party.
Other services: If a service doesn’t match your needs you are welcome to provide us with a proposal about what you would like to accomplish. Techie to the Rescue has the right to deny proposals and applications that are outside the scope of our service. You will not be compensated for unsolicited ideas that Techie to the Rescue decides to implement.
Governed by: These Terms and Conditions are governed by the laws of the state of Massachusetts, without regard to conflicts of law principles, and the parties irrevocably submit to the exclusive jurisdiction of the state and federal courts; however you may have other rights, which vary by jurisdiction. You should keep copies of these Terms and Conditions, and any sales receipts or other materials, for your records. Techie to the Rescue reserves the right to substitute, change, cancel, or add to any part of these Terms and Conditions or end the offer at any time without notice.
